Long service leave for New South Wales

We’re on a bit of a roll here…

People located in “The Premier State” can now book long service leave using Bindle.

As we mentioned in the last post, each Australian state and territory has a different way of calculating long service leave (LSL) entitlements. This means we need to create a separate leave calculator for each one.

After having a good read through the NSW Long Service Leave Act 1955 No 38 (a riveting read), we cranked out a leave calculator that reflects the legislation.

Most employees in New South Wales qualify for long service leave after a period of 10 years continuous service. It depends if you are on a weird workplace agreement or not,1 but normally, you’re entitled to 2 months (8.67 weeks) of paid leave.

For each 5 year period after qualifying (e.g. at 15 years service), you’re entitled to another month (4.33 weeks) of paid leave.

It’s important to note that these balances only apply to taking time off, and do not apply to calculating the pay out due on termination. There is a different calculation for that.

If you are after the pay out on termination, you can use the long service leave calculator on the NSW Industrial Relations web site. Please note this government calculator does not give the correct leave balance for taking long service leave.
